Last night, the Michigan state Supreme Court ruled that affirmative action is unconstitutional and that race can not be a factor in the admissions process for public universities. It’s a very good day. But it’s important to remember that affirmative action as we know it is a recent development. In the early 1900’s, many non-English speaking immigrants were denied access to the U.S. But that changed with the so-called “Equal Protection Clause.” The Supreme Court decided that the country’s borders must be opened to people who are denied entry to the United States under the old rules. So white people who were born in the United States and who spoke only English were assumed to be “equal” under the law. And similarly, African-Americans and other non-English speakers were granted equal access to “the American way.”
What seems obvious today is that affirmative action is only a temporary fix. It is not a permanent fix. It is a stop-gap that will last so long that it will really be worth nothing. Those who support affirmative action have said, “It’s wrong to legislate racial inequality because it’s wrong.”
If affirmative action were, in fact, wrong and legislated racial inequality were somehow an acceptable thing, then why wouldn’t it be acceptable for the government to take something that’s wrong and make it right? They could punish abortion by mandating that every pregnant woman have to give birth. Or they could force taxpayers to pay for the funeral of every soldier who dies in combat. But they don’t do that.
